Hold Harmless and Limited Liability Agreement
READ CAREFULLY BEFORE SIGNING — THIS IS A LEGALLY BINDING DOCUMENT
1. Agreement to Participate
By signing this agreement, I, the undersigned Participant (or Parent/Guardian signing on behalf of a Minor Participant), hereby acknowledge and agree to participate in a Valor Archery Challenge event.
2. Acknowledgement of Risks
I understand that archery is an inherently risky activity and that there is a potential for injury, including but not limited to:
3. Assumption of Risk
I hereby voluntarily assume all risks associated with my participation in the Valor Archery Challenge event, including but not limited to those listed above. I understand that Valor Archery Challenge and its staff, volunteers, and agents have taken reasonable precautions to ensure safety, but cannot guarantee complete safety.
4. Release of Liability
I hereby release, waive, discharge, and covenant not to sue Valor Archery Challenge, its directors, officers, employees, volunteers, agents, and any other persons or entities associated with the event from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or relating to my participation in the event, including but not limited to any and all injuries, losses, or damages, whether caused by negligence or otherwise.
5. Indemnity
I agree to indemnify and hold harmless Valor Archery Challenge, its directors, officers, employees, volunteers, agents, and any other persons or entities associated with the event from any and all claims, demands, actions, and causes of action brought by any third party arising out of or relating to my participation in the event.
6. Insurance
I acknowledge that I am responsible for obtaining and maintaining my own health insurance coverage.
7. Compliance with Rules
I agree to abide by all rules and instructions provided by Valor Archery Challenge staff and volunteers.
8. Severability
If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
9. Entire Agreement
This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Colorado.
11. Consent to Use of Images
I consent to the use of my image and likeness in photographs and videos taken at the event for promotional and marketing purposes by Valor Archery Challenge.
12. Refund Policy
Valor Archery Challenge refunds are allowed up to 30 days prior to the start of the event or unless Valor Archery Challenge cancels an event. No refunds will be offered from SimpleTix, our 3rd party registration platform, for their fees. No refunds will be offered after the 30-day-prior-to-event deadline.
13. Adult Participant Signature
By signing below, I acknowledge that I have read, understood, and agreed to the terms of this Hold Harmless and Limited Liability Agreement.
SECTION 14 — MINOR PARTICIPANT: PARENTAL / GUARDIAN CONSENT AND ASSUMPTION OF RISK
14a. Parental Assumption of Risk on Behalf of Minor
The undersigned parent or legal guardian fully acknowledges that archery is an inherently risky activity. By signing below, the parent or legal guardian voluntarily assumes, on behalf of the Minor Participant and themselves, all risks associated with the Minor’s participation in any Valor Archery Challenge event, including but not limited to the risks identified in Section 2 above. The parent or legal guardian further agrees that Valor Archery Challenge is not responsible for any injury, harm, or damages suffered by the Minor Participant during or arising from the event.
14b. Parental Release and Hold Harmless
The undersigned parent or legal guardian, on behalf of themselves, the Minor Participant, and all heirs, executors, administrators, assigns, and legal representatives, hereby releases, waives, discharges, and covenants not to sue Valor Archery Challenge, its directors, officers, employees, volunteers, agents, and any other persons or entities associated with the event from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or relating to the Minor Participant’s participation in the event, including but not limited to any and all injuries, losses, or damages, whether caused by negligence or otherwise.
14c. Parental Indemnification
The undersigned parent or legal guardian agrees to indemnify and hold harmless Valor Archery Challenge, its directors, officers, employees, volunteers, and agents from any and all claims, demands, actions, or causes of action brought by any third party arising out of or relating to the Minor Participant’s participation in the event.
14d. Supervision Responsibility
The undersigned parent or legal guardian accepts full responsibility for supervising the Minor Participant during all Valor Archery Challenge events and for ensuring the Minor complies with all safety rules and instructions provided by Valor Archery Challenge staff and volunteers.
14e. Authority to Sign
The undersigned represents and warrants that they are the parent or legal guardian of the Minor Participant named below and have full legal authority to execute this waiver and release on the Minor’s behalf.
14f. Acknowledgement
By signing below, I, the parent or legal guardian, acknowledge that I have read and fully understand this agreement, that I am signing it freely and voluntarily, and that I understand it is a legally binding document.
